NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Sponsor
The X: Seekers of Fortune Giveaway ("Giveaway") is sponsored by Mega Moth Studios LLC, 8000 Research Forest Dr. Ste 115-36, Spring, TX 77382-1504 ("Sponsor").
2. Eligibility
The Giveaway is open to legal residents of the fifty (50) United States and the District of Columbia, Canada, the United Kingdom, and the European Union, who are at least eighteen (18) years old and have reached the age of majority in their jurisdiction of residence at the time of entry.
Employees, officers, managers, members, contractors, and immediate family members of Mega Moth Studios LLC, and persons living in the same household as such individuals, are not eligible to enter.
Void where prohibited or restricted by law.
3. Giveaway Period
The Giveaway begins on [START DATE] at [START TIME] Central Time and ends on [END DATE] at [END TIME] Central Time ("Giveaway Period").
Entries received outside the Giveaway Period will not be eligible.
4. How to Enter
During the Giveaway Period, visit [GIVEAWAY URL] and submit the Giveaway entry form using a valid email address.
As part of the entry process, entrants will be added to the Mega Moth Studios mailing list to receive news, product updates, promotions, and other communications from Mega Moth Studios.
There is no charge to subscribe. Entrants may unsubscribe from marketing communications at any time using the unsubscribe link contained in Mega Moth Studios emails. Unsubscribing after submitting an entry will not cancel or invalidate an otherwise eligible Giveaway entry.
Limit one (1) entry per person and email address during the Giveaway Period.
Automated, fraudulent, duplicate, incomplete, or otherwise improper entries may be disqualified at Sponsor's discretion.
5. Prize
Three (3) winners will be selected. Each winner will receive the same prize.
Each winner will receive:
One (1) copy of X: Seekers of Fortune – Deluxe Edition
Approximate Retail Value ("ARV"): $69.99 USD per prize.
The total approximate retail value of all prizes is $209.97 USD.
The total number of prizes available is three (3). No more than three (3) prizes will be awarded.
The prize is not transferable or redeemable for cash. Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable.
Sponsor is responsible for standard shipping of the prize to the winner within the United States, Canada, the United Kingdom, or the European Union, as applicable.
Any customs duties, import taxes, VAT, or similar charges, if applicable, are the responsibility of the winner.
6. Winner Selection
After the Giveaway Period ends, Sponsor will randomly select three (3) potential winners from all eligible entries received.
Each selected winner will receive one (1) prize as described above, subject to verification of eligibility and compliance with these Official Rules.
The odds of winning depend on the number of eligible entries received.
7. Canadian Entrants – Skill-Testing Question
Before being confirmed as a winner, any potential winner who is a resident of Canada must correctly answer, without assistance, a time-limited mathematical skill-testing question administered by Sponsor.
A Canadian potential winner who fails to correctly answer the skill-testing question will not be declared a winner and may be disqualified. In that event, Sponsor may randomly select an alternate potential winner from the remaining eligible entries.
8. Winner Notification
Each potential winner will be contacted using the email address provided with their entry.
Each potential winner must respond within seven (7) days of the notification.
If a potential winner:
cannot be contacted;
does not respond within the required period;
is determined to be ineligible;
if a Canadian resident, fails to correctly answer the required skill-testing question; or
fails to provide information reasonably necessary to deliver the prize,
that potential winner may be disqualified and Sponsor may randomly select an alternate potential winner.
Sponsor is not responsible for winner notifications that are lost, filtered as spam, blocked, or otherwise not received.
9. Verification of Eligibility
Sponsor may require each potential winner to verify identity, age, eligibility, and mailing address before awarding a prize.
Award of each prize is contingent upon compliance with these Official Rules and, for Canadian residents, successful completion of the skill-testing question described above.
10. Taxes
Any federal, state, provincial, local, or international taxes, duties, VAT, or other costs associated with acceptance or use of a prize that are not expressly stated in these Official Rules are the responsibility of the winner.
11. Publicity
Except where prohibited by applicable law, acceptance of a prize constitutes permission for Sponsor to identify each winner by first name, last initial, and city/state, province, or equivalent region of residence in connection with announcing the results of the Giveaway without additional compensation.
12. Privacy
Email addresses and other information submitted in connection with the Giveaway will be used to administer the Giveaway and may be used by Mega Moth Studios to send marketing communications in accordance with applicable law and the consent provided by the entrant.
Recipients may unsubscribe from marketing communications at any time using the unsubscribe mechanism provided in those communications. Unsubscribing will not invalidate an otherwise eligible Giveaway entry.
13. General Conditions
Sponsor reserves the right to disqualify any entrant who attempts to tamper with the entry process, obtain entries through fraudulent or automated means, interfere with the operation of the Giveaway, or otherwise violate these Official Rules.
If the Giveaway cannot be conducted as planned because of technical failures, fraud, unauthorized intervention, or another circumstance beyond Sponsor's reasonable control, Sponsor may suspend, modify, or terminate the Giveaway and, if appropriate, select winners from eligible entries received before the affected event.
Sponsor's decisions concerning the administration of the Giveaway and interpretation of these Official Rules are final, subject to applicable law.
14. Release and Limitation of Liability
To the fullest extent permitted by applicable law, entrants agree to release and hold harmless Mega Moth Studios LLC and its members, managers, employees, contractors, representatives, and agents from claims arising out of participation in the Giveaway or the acceptance, possession, use, or misuse of any prize, except to the extent such claims cannot legally be waived.
Sponsor is not responsible for technical failures, interrupted internet connections, inaccurate entry information, lost or delayed communications, or other circumstances outside Sponsor's reasonable control.
Nothing in these Official Rules excludes or limits any rights or remedies that cannot lawfully be excluded or limited under applicable consumer-protection law.
15. Governing Law
To the extent permitted by applicable law, the Giveaway and these Official Rules are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any dispute relating to the Giveaway shall be brought in a court of competent jurisdiction located in Montgomery County, Texas.
Nothing in this section deprives an entrant of any mandatory rights or protections available under the laws of the entrant's jurisdiction of residence that cannot lawfully be waived.
16. Winner Information
To request the names of the winners, send an email to support@megamothstudios.com with the subject line "X: Seekers of Fortune Giveaway Winner" within thirty (30) days following the end of the Giveaway Period.
